Terms of Sale & Conditions
General terms governing use of the Taja Marble website and information provided through it.
011. Acceptance and contractual effect
These Terms of Sale & Use form part of the commercial framework between Taja Marble and the buyer. Unless a written agreement signed by Taja Marble expressly states otherwise, a buyer who pays a deposit or full payment, approves a quotation, proforma invoice, order summary, drawing, material selection or sample, or otherwise instructs Taja Marble to commence procurement or production is deemed to have accepted the quotation or proforma together with these Terms. A link to these Terms may therefore be incorporated into quotations, proforma invoices, order confirmations and related commercial documents.
022. Order documents and priority
Each order is governed by the project-specific written documents issued or approved for that order, which may include the quotation, proforma invoice, order summary, approved technical drawing, approved dimensions, material or slab selection, finish, quantity, delivery term and written variations. Where there is an inconsistency, the most recent mutually confirmed project-specific written document takes priority over general website descriptions. Verbal discussions do not amend an order unless confirmed in writing.
033. Natural stone characteristics
Natural stone is a geological material and is not a uniform manufactured surface. Colour, tone, veining, fossils, movement, clouding, mineral deposits, pinholes, pores, fissures, resin, filling, surface variation, texture and other natural characteristics may vary between blocks, slabs, samples, photographs and finished pieces. These characteristics are not, by themselves, defects. Digital images, screens, samples and small cut pieces cannot guarantee the exact appearance of a full slab or finished product.
044. Material selection and approval
Where photographs, slab images, samples, dry layouts or selections are provided for approval, the buyer is responsible for reviewing them promptly and raising material concerns before approval or production. Unless expressly agreed otherwise, Taja Marble may make reasonable production decisions concerning cutting position, vein placement, matching and use of material while seeking to respect the approved design intent and practical characteristics of the stone.
055. Custom-made products
Many Taja Marble products are made specifically to the buyer’s dimensions, finish, stone selection, faucet configuration, edge detail or other project requirements. Custom and made-to-order goods enter procurement or production following the agreed commercial trigger and may not be cancellable, returnable or refundable once material has been reserved, cut, fabricated or otherwise committed, except where mandatory law requires otherwise or Taja Marble agrees in writing.
066. Dimensions, tolerances and technical responsibility
The buyer must verify site dimensions, wall conditions, plumbing positions, faucet specifications, clearances, installation heights and compatibility with third-party components before approving production drawings. Stone fabrication requires practical manufacturing tolerances; minor dimensional variation may occur. Unless Taja Marble has expressly accepted responsibility for a specific site measurement in writing, dimensions supplied by the buyer, designer, architect, contractor or installer remain their responsibility.
077. Drawings and approvals
Technical drawings and order summaries are prepared to define production intent and should be reviewed carefully. Approval authorises production on the basis shown. Changes requested after approval may affect price, material use, production time and delivery and may require a revised quotation. Taja Marble is not responsible for consequences arising from an approved dimension, configuration or specification supplied or confirmed by the buyer.
088. Prices, taxes and quotations
Prices apply only to the scope stated in the relevant quotation or proforma invoice and for the validity period shown there. Unless expressly included, local import duties, customs charges, destination taxes, installation, site handling, storage, lifting equipment and third-party services are excluded. Changes to dimensions, stone, finish, quantity, packaging, delivery destination or scope may require repricing.
099. Payment
Payment amounts, deposits, balances, currencies and due dates are those stated in the applicable quotation or proforma invoice. Production, material reservation, dispatch or release of documents may be conditional on receipt of the required payment. Bank charges, intermediary fees and conversion costs charged by financial institutions are the buyer’s responsibility unless expressly agreed otherwise. Late payment may postpone production or dispatch.
1010. Lead times
Production and delivery periods are estimates unless a specific date is expressly guaranteed in writing. Timing may be affected by material availability, quarry or block conditions, production complexity, approval delays, buyer changes, carrier capacity, customs procedures, weather, public holidays, force majeure and other circumstances outside reasonable control. Taja Marble will use commercially reasonable efforts to communicate material changes to expected timing.
1111. Packaging and shipment
Products are packed according to their material, dimensions, weight and planned transport method. Packaging is intended to provide reasonable protection during normal handling and transport but cannot eliminate every transport risk. Heavy stone products may require mechanical handling, suitable access, specialist unloading or additional labour at destination. The buyer is responsible for ensuring that the delivery location can safely receive the shipment.
1212. Delivery terms, customs and import
The applicable delivery basis is the Incoterm or delivery condition stated in the quotation or proforma invoice. Where delivery is stated as DAP or otherwise excludes import clearance, the buyer is responsible for destination-country customs clearance, import duties, taxes, brokerage, permits and other destination charges unless the written order expressly states otherwise. Carrier estimates do not constitute guaranteed delivery dates.
1313. Inspection on delivery and transport damage
The buyer or receiving party must inspect the shipment and packaging at delivery before signing an unconditional receipt. Visible damage, broken crates, impact marks or missing packages should be recorded immediately on the carrier’s delivery record and supported with clear photographs and video. The buyer should notify Taja Marble promptly and preserve the packaging and damaged goods while any carrier or insurance review is pending. Failure to document visible transport damage at delivery may materially limit the ability to pursue a freight or insurance claim.
1414. Claims after receipt
Any concern regarding quantity, dimensions, fabrication or visible condition should be reported promptly after receipt and before installation, modification or use. The buyer should provide photographs, measurements and other reasonable evidence requested to evaluate the issue. Installation, drilling, cutting, sealing, alteration or use of a product may make it impossible to determine the original condition and may limit available remedies except where mandatory law provides otherwise.
1515. Installation and site conditions
Unless installation is expressly included in writing, Taja Marble supplies the stone product only and does not control site preparation or installation. The installer is responsible for verifying substrate strength, wall construction, brackets or supports, waterproofing, adhesives, sealants, anchoring, plumbing, lifting methods and compliance with local building requirements. Heavy wall-mounted or cantilevered stone elements require appropriately engineered support and competent installation.
1616. Care, sealing and maintenance
Natural stone may react to acids, oils, pigments, moisture, unsuitable cleaners and environmental conditions. Appropriate sealing, cleaning and maintenance depend on the stone, finish and application and are the responsibility of the owner or installer unless a specific written service has been purchased. General care guidance is informational and does not replace product-specific professional advice.
1717. Remedies and limitation
If Taja Marble accepts that supplied goods materially fail to conform to the confirmed order, the appropriate remedy will be assessed in light of the nature of the issue, the product, its custom character, transport status and applicable law. Where legally permitted, remedies may include repair, replacement of the affected component, remake, credit or another reasonable solution. Taja Marble is not responsible for indirect or consequential losses, loss of profit, project delay costs, third-party labour, removal or reinstallation costs except to the extent such exclusion is prohibited by applicable law or expressly accepted in writing.
1818. Buyer-supplied information and third-party products
The buyer is responsible for the accuracy and suitability of specifications, drawings, faucet data, hardware, appliances, brackets, templates and other third-party information supplied to Taja Marble. References to third-party brands or products do not constitute a warranty by Taja Marble regarding their performance, availability or suitability.
1919. Intellectual property and project imagery
Website content, Taja Marble drawings, layouts, photographs, renderings, catalogues and downloadable resources remain protected by applicable intellectual-property rights unless otherwise stated. Project-specific drawings may be used for the relevant project but may not be commercially reproduced or presented as another party’s work without permission. Any use of completed-project imagery by Taja Marble will be subject to applicable rights, permissions and confidentiality commitments.
2020. Force majeure
Taja Marble is not responsible for delay or failure caused by events beyond reasonable control, including natural events, quarry interruptions, transport disruption, strikes, war, civil disturbance, government measures, customs delays, epidemics, energy interruption, carrier failure or similar events. Obligations affected by such an event may be suspended for the period reasonably required by the circumstances.
2121. Website information
Website content is provided for general information and may be updated without notice. Product images, descriptions, stock information, dimensions and availability shown online should be confirmed in the project-specific quotation or order documentation before reliance. Links to third-party services are provided for convenience and are governed by those third parties.
2222. Governing law and mandatory rights
The governing law, competent courts or dispute-resolution terms applicable to a particular sale should be stated in the relevant quotation, proforma invoice or separately agreed commercial document. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded under mandatory applicable law. If a provision is held unenforceable, the remaining provisions continue to apply to the extent permitted.
2323. Changes and written exceptions
Taja Marble may update these website Terms for future transactions. The version referenced by or available at the time an order is accepted should be retained with the order records. Any exception to these Terms for a particular order must be confirmed in writing by Taja Marble.
